My question involves a child custody case from the State of: NC
My fiance goes to court this month with his ex over custody of his 10yo daughter. The child expressed wishes to reside with us and ex flipped out and file for full custody. Since seperation in fall of 2007 child his primarily resided with mom, with every other weekend with dad. Mom has denied visitation countless times even tho cs was always paid. Has refused dad phone access to the child unless its on speaker phone and she coaches the girl on what to say. This child has absolutely no independence or responsibilities because she has not been taught them. She lies constantly and ex brags about it. She is very overweight because ex does not enforce healthy habits, at 10 the kid is 150+ pounds. My fiance believes ex may have commited fraud with a public website she had established claiming the child had died in 2009 of a rare degenerative disease in order to collect money, ex even has family and friends commenting on site how the child will be missed and she was such a trooper and special girl. We do have printouts of all that as well as ex's arrests for public drunkeness. With what we do have does my fiance stand a chance in court of custody or at least closer to 50/50?
