    Default Taxes Withheld, Issued 1099

    Hello all,

    My sister worked for a fairly shady computer repair place for awhile this year. I usually help her with her taxes every year, and feel I'm fairly proficient, but this is way above my head.

    She had taxes withheld each paycheck. She has Quicken printout showing what she was paid and withheld, essentially a paystub, but not quite. Well, said shady employer issued her a 1099 this year. She's tried calling the business owner many times with no success. She has gotten a hold of this owner's accountant, who said he was told to issue 1099's and that taxes weren't withheld.

    It sounds like he took their tax money and pocketed it himself.

    I have two questions now. My sister and her fellow former employees just want this to be fixed, ideally. My thoughts are a certified letter to the business location (he has many, maybe send it to all of them, or just the one she worked for) for starters, requesting he issue W2's as required by law or they will file suit to see if that fixes the problem, but my experiences with him are absolutely it won't get fixed. If it doesn't get fixed, I think they are all going to go to court over this, but how to file taxes this year?

    She would file using a substitute W2, using the information from the Quicken printout. Most software can accommodate this.
