    Unhappy Connecticut Security Deposit With No Documentation of Condition

    I'm moving out of my Connecticut apartment at the end of this month (Nov, 06) and am rather worried since there was no form filled out regarding the condition of the apartment when I moved in. The apartment building is the fourth in my complex and it was still being built when I moved in. The management who was in charge back then has since been fired for incompetancy and so has the group that came in after them. It was the first apartment I had ever moved into and I didnt realize I was supposed to have had a walk through with the management upon first moving in.

    Does the lack of this checklist hurt me, the landlord, or both of us in regards to me getting charged for 'damages' to the apartment when I move out? The apartment wasn't completely finished when I moved in, there are areas that havent been painted, the rug was never stretched correctly, and no protective covers were put over the end. Also, (and I dont know if this matters) my air conditioning has never worked, even though I've tried to get them to fix it multiple times) I am terribly afraid that they will steal my security deposit for these things since I dont have a paper stating condition from when I moved in. However, without that paper, I dont see how they can prove that the apartment was in great condition when I moved in either.

    Does anyone know how Connecticut law would work in a situation like this?

    Reviewing this guide, it does not appear that the absence of an official checklist would impair their ability to pursue you for damages to the unit, although it may impair your ability to defend. However unless they produce evidence as to its condition, perhaps through the testimony of a member of the former management company, it would be difficult for them to establish the condition at the time you moved in.
