    Default My Lawyer Doesn't Think My Complaints About My Ex Will Be Substantiated in Court

    My question involves a marriage in the state of: Indiana
    My ex wife is in default of all the orders in our divorce decree. I am trying to hold her in contempt by taking her to court but once again our lawyer acts as though I have no chance in the world of making anything stick. My draughts are in a very unstable environment. My 13yr old currently weighs 273lbs and is way over medicated. My 11 yr old weighs close to 150lbs. When the case started they had missed over 40 days of school and were failing out. But my exs lawyer has had it continued so many times that they have been able to miss less school and improve grades which doesn't help our case or show the judge the truth. We have reason to believe there are drug being used and dealt out of the house. We have called cps but they have yet to do anything. My ex filed bankruptcy on the house and car she was court ordered to put in her name on. The bank ended up foreclosing on the house but coming after me on the car. I took care of all my obligations in the divorce decree. So in the end I had to file bankruptcy myself. I told all this to my lawyer. Now today the day before our case she is saying we cannot hold my ex in contempt for the bankruptcy without getting her and myself into trouble. I have looked relentlessly through the web trying to find a case to back either side of this for or against it but I can find nothing. If anybody can help me or show me cases to back it up I would greatly appreciate it!!

    I just want the best for my girls and all my ex wants is more money. Please help! We have 11000 wrapped up in this so far to be told the day before our third hearing there is nothing we can do your wasting your money!

    I'm a good dad! I do everything in suppose to do! I WANT to be with my girls unlike some other fathers but I'm made out to be a bad guy!

    When did the tardies/absences occur?

    (that's really all you have - and that's only if they're relatively recent)

    Bankruptcy isn't an issue; family court cannot prevent a person from filing and certainly can't penalize them for doing so.
