    Default Mistreatment by Co-Workers After I Complained About Their Harassment

    My question involves labor and employment law for the state of: Texas

    I filled a claim for harassment and retaliation at work few months back. Lately however I am seeing hostile behavior from few of my co-workers that were part of my original complaint, and my job assignments have also changed recently. I have few other guys who are in the same position and have the same title I do however now my boss wants me to come in on occasional Saturdays and help a different department with stuff while the other guys with the same title and position that I have don't have to.
    I discuss the hostile behavior with my immediate managers but they pretty much told me that they are going to close the books on that issue. They are also making my job harder by having the guy before me do less, and having the guy after me call in or come in late/leave early and adding more stuff that needs to be done that wasn't being done before, not granting me full access to software to complete my paperwork, even though everyone else in my position have access to it. Moving all experienced operators from my shift so I'm stuck with guys who have no idea what to do. Any suggestions?

    There is a reason I am asking this question, and how you answer it has a direct bearing on what, if any, legal options you have.

    Specifically what was happening that you reported as harassment? What did you do that you were being retaliated against?

    We had our " confidential" employee engagement survey and I reported some issue and concerns in that survey. But apparently my manager decided to read what I put on there in a company meeting, Not sure if he mentioned my name or not because I wasn't there. Now my corporate bosses saw the issues that I reported and penalized the management for it. And my management decided to have literally everyone in the plant go against me.
    I kept dealing with harassment and retaliation and I finally reported two guys, then these two guys made it look like I was just spreading rumors and tried to get me fired, I reported the issue to corporate again and those two guys were let go. Now when I went back to work I picked a position in a different department to get away from some of the guys that were involved in that investigation. Now I am starting to see similar issues again and when I reported that to my managers they pretty much told me that I am just assuming things.
    We had another survey couple of months ago and and i didn't put any comment and pick excellent on every question except training issues, after that I started hearing remarks about training from several co-workers. I also hear remarks and things that I mentioned in my complaint but all these guys say it like they are referring to something else.

    None of that is illegal harassment or illegal retaliation. So your options are pretty much limited to sucking it up or finding another job.

    I'm not unsympathetic, really I'm not. But "retaliation" is one of the current buzz words that's getting thrown around without most people really understanding what it means, in terms of employment law. Just like most discrimination is legal, most retaliation is also. This is the legal kind.

    " The law forbids retaliation when it comes to any aspect of employment, including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment."

    I am seeing my job assignments change as well as I am being told to help a different department w/o any proper training. I ask my boss if I could come in on my day off and train with some one in that department but I am being put on different hours with a more experienced guy who has the same position I do so I am getting the training but not in the part where Ill have to take care of stuff on my own in less then a month.

    Yes - retaliation for a protected activity, or as part of a characteristic protected by law.

    Which answering employee surveys is not.
