    Default Got Citation for Evasion of Fare After Forgetting My VTA Ticket

    Hi,

    Today, I got a citation for evasion of fare on the VTA light rail system in San Jose, CA. I work for a software company which has agreement with VTA and we get passes every year
    which is automatically renewed.

    i went out of country around 20th december and came back today on 7th january. i was coming from nyc to chicago then los angeles and then bus to san jose. with all the snowstorm, it took me 36 hours to come to san jose. i had to take trains, flights, cabs and a bus to reach san jose, and i was very tired. in all this i forgot that i need to have new 2104 sticker, which i needed to pick from my office. It just totally slipped my mind that i have entered new year and i boarded the train.
    I had 2011, 2012 and 2013 stickers on my id card. i tried to explain this to officer to no avail. another vta officer said if it was her she would have not given the ticket.

    what are my options. Is it good if i contest. I am not a us citizen.

    You're guilty. Pay the ticket. Everyone has a "someone else said if it were them they wouldn't have written me the ticket" story, but the fact is it wasn't her and you did get a ticket. I forgot is not a defense. I had stickers from the other years aren't a defense (how are they supposed to know that you weren't laid off effective 12/31?).

    What you tried to (and successfully) explain to the officer is exactly what they needed to know. You boarded a train without paying the appropriate fare. You were cited for it.

    Totally understood. one final question. i had no idea that i could contest fare evasion tickets.
    The other office said that take your employment proof and contest in court and then i started reading about it.
    Is there any disadvantage of contesting?

    The only disadvantage I can think of is the waste of a day's pay/vacation time/sick time you're going to have to use in order to find yourself guilty anyway. If you have time to waste, then by all means contest it. You won't be any worse off than you are already.
