    Default How Can a Minor Get Emancipated in New York

    In the state of NY, there is no legal process for a minor to file for emancipation. A minor is considered emancipated when the following conditions are met:
    -The minor must live separate from the parents.
    -The minor must not be in foster care/
    -The minor must not receive any support from their parents.
    -The minor must be able to financially support themselves.

    My question is, if a minor can't file for emancipation, but considered emancipated when these criteria are met, how can a minor be considered emancipated without "technically" running away from their home?

    By having permission to move out.

    Emancipation is not a right.

    What if child abuse is involved? Could the minor become emancipated instead of being sent into the system?

    Nope. Not unless they meet the qualifications.

    Emancipation is not and never was intended to be a means for a minor to leave home. It was and is intended to be a means to provide legal protections to those teens who are already living on their own.

    As other teens on this board have been told before - it doesn't matter if your parents are beating you, starving you, and leaving you locked out of the house in a blinding snowstorm wearing nothing but your underwear. If you do not meet ALL the qualifications to be emancipated in your state, then you will not be emancipated.

    Thank you, but I'm not a teen on this board seeking to become emancipated. I'm simply trying to learn more about the laws around it. Thank you again for your help though.
