    Default What to Do when the Detective on Your Case Won't Return Your Calls

    My question involves criminal law for the state of: Kansas

    About 1 year ago from today, I had over 1,000$ of property stolen from me by an old roommate who was already on parole. The detective contacted me, I gave him all the information (receipts, recorded phone calls with thieve admitting to the crimes, etc.) He (the detective) did not contact me for 1 month. So I tried calling him and left a very sincere voicemail. Another police officer at a local gas station told me to keep trying to contact him about every 2 weeks. So EVERY 2 weeks for the past year I have contacted this detective and each time I reach his voicemail. I have left him a voicemail over and over, each time very nice and sincere. I record all the voicemails I have left him as well. After 9 months he finally answered when I called, told me he has no idea why I don't have a court date yet and he'd look into it and call me right back. He didn't. Another 3 months have went since then with me still calling every 2 weeks, with no luck. A year later, still haven't got anything set up.


    What is my next step?? What can I do? Thanks in advance.

    The reason he's not responding is it's out his hands now. You may need to contact the DA and ask the question.

    It could also be that they've chosen not to prosecute.

    they told me they were going to prosecute. And although I had receipts for 1,085$ worth of stolen goods + a watch I had + 56 lortabs, + he was already on parole for grand theft, they were still only going to prosecute it as a misdemeanor, not grand theft. He wouldn't give me an answer as to why, but I have heard its possible that the lawyer is just being lazy. I just want restitution. He has the money to pay, why aren't they making him pay?

    I guess I will try to contact the DA. Any other advice you or anyone can give?

    Perhaps they changed their minds? Prosecutorial discretion and all that.

    Or maybe he's going for what he can get a conviction on. Since the goods were only just barely above $1000 when purchased brand new, it's kinda tight. A good defense attorney could disprove the value, especially if the goods were used.

    Because they can't. Only a court can order him to pay. They can make it a part of a plea deal if they choose to.

    Be careful that you aren't too much of a greasy wheel. Some folks can get annoyed by it. If you have questions about why something is being handled the way it is, be polite.

    If it's not too late, try looking into small claims court.
