    Default Charges for Stealing From My Employer

    My question involves criminal law for the state of: Arizona

    New to the forum and need some guidance. I stole money from my previous job and was fired for it and the police were called. I stole less than $1000 so it's a class 1 misdemeanor. But it was spread out to 3 times to equal the amount it was. So I went to my court date and now they are charging me with 3 counts of theft class 1 misdemeanor. And I have to go back to court again in a month for a trial I guess because the company I worked with is pressing charges to the fullest extent. I have a clean record and am wondering if anyone knows what I'll most likely get sentenced? Jail time? Probation? I just need an idea. I would hope just fines and pay the money back...

    You absolutely need a lawyer. I can 100% guarantee that it will be more than just a fine and restitution. You COULD get six months plus $2500 fine on each charge (plus costs). What I suspect you'll get is three years of probation + paying the various court and probation costs + restitution.

    However, with a aggressive victim and hardboiled DA and some aggravating factors, you could end up in jail.

    You need a lawyer, if you are indigent and can not afford one, you should have asked/applied for one at your first appearance. Why are screwing around with serious criminal charges hanging over you?

    I just hope I don't go to jail. I somehow got another job at a competitor doing the same thing and making more money. If I go to jail I'll lose it and I would be leaving my spouse to pay the bills, which she can't do alone... I should've got a lawyer but I had no idea it was going to be this serious. When I got arrested and got my ticket it said one count of theft. So I figured I'd breeze through this with some fines. Now after my first court date I'm very worried with the three counts. I'm definitely gonna have to get a lawyer. But would it really do me any good? When I was being interrogated by my previous employer before they called the police, I admitted guilt and explained how I did it on tape. Could a lawyer possibly just get me a more minor punishment?

    Thank you for the advice by the way. I really appreciate it as I have no idea what I'm doing or what to expect.

    Depending on your history....a lawyer can often negotiate a plea bargain for you - you plea guilty to a lesser charge, which = lesser punishment.

    Most judges are going to see the "3" events were all one....you admitted guilt which was your 1st mistake . Never talk to anyone when accused of anything...that being said as a former police officer I suspect you'll be sentenced to fines,community service,theft classes,restitution and possible license suspension and then 30,60,90 days in jail with ALL suspended on condition you have NO further incidents while on a 2-4 year active probation....also if you use alcohol or drugs...stop...it's likely a pre sentence report will be conducted and if you pee positive expect active jail time. Also draft a good sincere apology letter to the victim and read it when offered the opportunity and make sure it's sincere not half assed.

    Again I doubt ....very much doubt that 3 offenses basically committed in one time frame will result in jail time....judges aren't judges because they are stupid....they can read real honesty....remorse...promise NOT to repeat and the YOU be the one to offer restitution....but beware....only offer restitution schedule you can afford... Don't agree to 300 monthly if you can't or you'll violate your paper and wind up serving original time plus violation of conditions charges which can be harder than the underlying charges.....capeesh?
