    Default Who is Liable if Someone Gets Hurt Shoveling Snow on Your Property

    My question involves an injury that occurred in the state of: NY

    Say you hire someone to shovel snow and they have a heart attack or throw their back out while doing it.

    If you hire them as a contractor it is on them. They choose how to do the job and what tools to use etc..

    This is why you hire a company that is insured to remove snow. An incident like this would be covered under their workers compensation policy. Another problem is, if someone slips and falls after the snow is removed, that person is going to want to sue someone for their medical bills.

    If you hired someone that isn't insured, you will be the one being sued. If you hire a company that is properly insured, you pass there information to the lawyer that tries to sue you, so that lawyer could go after the company that removed the snow.
