    Post Consequences of Housing a "Runaway" Minor

    My question involves criminal law for the state of: California

    I just turned 18, living in California. My girlfriend is living a pretty rough and abusive life at home. Seems like any day now, she'll be kicked out into the streets. Being her boyfriend, I would take her in to live with me. Problem is her parents hate me. It's a pretty complicated situation for the simple fact that I feel like her parents would arrogantly call the police on me and my family, saying that I'm housing a runway minor, leaving out the part that they were the ones to kick her out in the first place. Yes I know, pretty hard situation, but knowing her parents, they'll probably end up doing that. Not being to familiar with runaway laws and other laws involving that situation, I would really appreciate it if I had some insight on this. Would I be charged with housing a runaway minor? If my girlfriend told law enforcement that she was kicked out, would that charge go away? And would child services step in from her parents kicking her out? Just a couple questions, to help get anyone started.

    We hear that every day. It's the nature of living life as a teenager - all parents are abusive and domineering (even when they are not, by any truly objective standard).

    But, for the sake of argument, let's assume that her parents are ogres.

    Seems like any day now, she'll be kicked out into the streets. Being her boyfriend, I would take her in to live with me.
    All sorts of legal problems with that.

    Like that.

    IF they "kick her out," she should call the police or child services. THEY will provide for her. If she shows up at YOUR place, YOU call them. If you take her in, your likely gonna be in trouble.

    Would I be charged with housing a runaway minor?
    COULD you? Yes.

    If my girlfriend told law enforcement that she was kicked out, would that charge go away?
    Only if you called the police the minute she showed up on your doorstep.

    And would child services step in from her parents kicking her out?
    They would provide for her care and look into the issue with the police as best they could.

    Yeah, let the OP call child services. Because a state foster-care system has never let anybody down, right? No abuses there, right?


    It would probably be better for the girl to be in the OP's hands than in the hands of child services. But, if the OP is concerned about police action, then perhaps the OP can arrange for the girl to stay with a friend or a relative of the OP's that the girl's parents do not know about.

    His OTHER option could very well be jail. His call.

    And, of course, no runaway minor has EVER been taken advantage of by a "friend" ... really? I could tell you horror stories ... I used to work Juvenile crimes including minor prostitution rings - very depressing stuff.

    Ah, wonderful - MORE people to potentially go to jail or to take advantage of the girl! Brilliant idea! So much better than calling the authorities or the parents!

    If mom and dad actually "Kick her out" you contact juvenile services and you let them decide where placement will be. Otherwise I can easily see the OP being charged with a "contributing to the delinquency of a minor" and the court ordering No Contact as a bond stipulation until the matter is resolved 4,8 or 16 weeks down the road.
