    Default Child Was Kicked Out - Can I Pay Support to the Child Instead of Her Mother

    My question involves child support in the State of: TN. My 18yo daughter is a Sr in high school, I am to pay support until she graduates in May, Recently my ex-wife made her move out and she is now living with her boyfriend. I would like the support to go directly to my daughter due to the fact my ex will not give her a cent of the support. What would be the fastest method to make this happen where I will not face any legal repercussion's. Also, my daughter lives 3 hours from me or else she would have moved in with me.

    If you want to give money to your daughter, then do so. That does not mean that you can quit paying support to the mother, however.

    If you believe you have grounds to modify support based upon mom's no longer supporting the child, bring a motion in court.

    However, unless you want to be on the wrong end of the resulting legal problems, until or unless you actually get that modification, you continue to pay the support as ordered. You do not get to unilaterally stop.

    You do understand that the support is to reimburse the CP for the money they've ALREADY spent on the minor, right?

    But even if a judge orders a modification retroactive to date of filing, any money that he pays to mom in the meantime he should expect to never recover. That's the unfortunate reality.

    I think speaking with a worker at the local enforcement agency MAY prove beneficial, if they are involved with enforcement of his order. There occasionally are helpful people there.

    Support ends in May. By the time he gets to court it will most likely be a moot point.
