My question involves paternity law for the State of: Minnesota

Hello,
I have a nine year old daughter. Her birth father has never signed away any of his parental rights, although he is not on the birth certificate. I am now divorced from my ex-husband who is not the father of my daugher. We put his name on her birth certificate when she was two years old, right around the time we got married. We did this only because I didn't want the birth father to try and take custody away from me. So my ex signed the recognition of parentage knowing he isn't the birth father. At the time we thought we would be together forever and divorce never crossed our minds. So his name is on the birth certificate, not the biological father.

Well, now that I am divorced and I have sole physical and legal custody of my daughter and my ex-husband has not been in contact with my daughter and my daughter knows who her real father is, I want to get my ex's name off of the birth certificate and put the birth father's name on. My divorce decree states all of this yet the birth records people will not change it. They say I have to go to court and have a judge sign a paper specifically saying to take off my ex and put the bio-dad on.

So I need to know what kind of paperwork I need to file in order to do this. I cannot afford a lawyer and I plan on going to court myself. Can someone please let me know what kidn of paper work I need to order to exracate my ex-husband from the birth certificate. Thanks.
