    Default Landlord is Making Temporary Repairs on Furnace

    My question involves landlord-tenant law in the State of: Kansas.

    About a month or so ago, my furnace quit blowing warm air. I called the maintenance folks, they were there that day and fixed it. Then last week, it quit again. I called and they said they'd try to get out there that day ( I don't know if they did or not, because I was gone. ) The heater still wasn't blowing warm air but the temperature was warm outside, so I figured I'd call them the next day. That morning, it started up just fine and worked for the next two days so I didn't call again. On the third day, it quit working, they came out and thought they'd fixed it again. The next morning, it wasn't working. I called the office, left a message which is supposed to get transferred to the on-call maintenance man and then went to stay elsewhere as the temperature had dropped below freezing and we were expecting a snow storm. I didn't hear back from them at all and on Sunday it was not working still. I called first thing Monday morning and they said they didn't know why no one got the message Saturday but they'd come out and get it fixed. They replaced the thermostat (which was what he thought might be broken on the Friday before when he was there). I got home Monday night - it would only work for about 5 minutes at a time and after I had to keep messing with the thermostat to get it to even turn on - my apartment was about 55 degrees and unless I kept messing with the thermostat, I couldn't get it to consistently work. That was yesterday, it was super late and I figured I'd suck it up instead of having to wait around for the maintenance guy to come by that night. I have called them twice today and left messages and heard nothing back. I know it's Christmas Eve and I don't want to ruin anyone's holidays but I don't know what I can do. I can't stay there if it's going to be 55 degrees - one night was fine but I can't do it all the time. I know that they've tried to fix it but it's starting to get ridiculous that I have to call them all the time and they never seem to get it completely fixed. I don't know what my options are - can I withhold rent, ask to be let out of my lease or get a proper HVAC company to come out?

    I've never had problems like this before as a renter and everyone keeps telling me to get pushy with the landlord. I'm not very good at that and I don't want to piss the landlord off.

    The problem is that the landlord/management HAS made a rather valiant effort to address your repair requests (at least four or five times by your posting) so if you attempt to withhold rent or get out of your lease your are likely to be facing a legal battle over this. The issues on repair requests and getting out of a lease or withholding rent often involve if a landlord/management IGNORES a tenants request for a repair. That doesn't seem to be the case here.

    And yes, it is Christmas eve and tomorrow is Christmas. Quite honestly, it may be useful to simply purchase a few space heaters to use for the next day or two until Christmas is over and they can come out and look at the unit again.

    As landlords we keep oil based radiator heaters available for holiday "emergency" situations with tenants but that's just us.

    Thanks Gail! That's what I thought. I know they've tried and it's as much as an inconvenience for them as it is me. I'll call them again after Christmas. I just wanted to check.
