    Question Failing to Pay Fines and Court Costs for Probation

    My question involves criminal law for the state of: Florida

    My fiancé was given 6 months probation for a misdemeanor...They have violated him because all of his money wasn't paid for his court cost and fines, they issued the warrant right at the end of his probation (two weeks before his probation ended)...I have the money to pay it but how can I get the probation office to accept the payment and release him before he is held past Christmas?

    I spoke with his attorney and he states that he will mention to the judge at first appearance in the morning that we have the money for the court fees and fines...but the probation office is telling me that at first appearance he won't get to make a plea of any sort

    It may also depend on what the was. For example, on a domestic, we won't accept any payments on the defendant's behalf if it from a victim.

    The violation is valid. He had an outstanding financial balance that was due with only two weeks left. He should have been violated. If he has the money to make it right, it should go in his favor. However, with two weeks remaining, the probation office can easily argue that if he managed to come up with the money now, he should have also been able to do it prior to the violation. All in all, the court will more than likely accept the payment and terminat his case once they set the hearing date.

    Thank you for the response. He actually did not come up with the money, my family did. It is not on a domestic issue. and now I am finding out that I can't even be present at first appearance because the court will be closed, and it will be done by phone...this sounds so confusing to me
