Yes, it can be done legally. Any employee can legally be made non-exempt. However, if you go ahead with this employee must be treated as if he is non-exempt. He will be due overtime if he works over 40 hours in a week. He will no longer have any legal expectation of being paid when he does not work.
What is the reasoning behind his request? It would make a difference as to what I would advise.
