My question involves labor and employment law for the state of: california
My mom work as a manicurist. Sometimes, it takes two people to work with customers. There is another employee that doesn't get along with Her. He often verbally attacks her, calling her disgusting names and makes offensive remarks. Owners ( husband and wife) supposedly took action, actually more like a slap on the wrist for the guy, ten months ago. However, he continues.
My mom has talked to one of the wife again but she doesnt do anything. My mom then asks me to text the husband. (He is not at the establishment often) He said he would take care of it. He took my mom into the office to talk, but the wife follows in. The huge barrier here is, my mom not fluent in english. The husband speaks only english. The wife is bilingual. She says she is translating but my mom knows its not being translated with the feeling she is projecting.
Now, because this is an ongoing, the owners are pretty annoyed with my mom. My mom wages are lower than everyone. Btw, they work on compensation so if they dont give you customers, you dont make money. While everyone else is making 200 to 300 a day, my mom stays below 200. When she asks how come her turns are skipped, they say its because of her skills, which I know isn't the truth. I mean, you fire an incompentent employee. And on top of that, the wife is mad she went to the husband so she is giving my mom the silent treatment. Worse, eveyone there is an immigrant so they are not fully informed with their rights so they fear that if they speak out, they will lose their jobs.
My question is, what is the best way to go about this situation? She literally has no ally and the owners arent doing anything with the abuser and retaliating against her. Will she even get a case?
