    Default Fired After Giving Two Weeks Notice

    My question involves labor and employment law for the state of: On Monday I resigned from my position and I was a salaried employee. I worked in sales and the new job I am going to in January is NOT linked to sales what so ever. I turned my letter in to the sales manager and sat through the sales meeting and was interactive with that meeting. That meeting concluded at 1130 AM and started at 0900 and I gave the sales manager my letter prior to the sales meeting. At approximately 130 PM the sales manager called and said the owner wanted me to leave today and turn in all my company property. The sales manager further stated he would not be back until 4 PM - 5 PM. My question is this. Am I entitled to my two week salary because I gave a notice or just the one single day of pay?

    WHAT STATE IS THIS? We ask that for a reason. The laws vary.

    Typically, unless you have a contract that specifies otherwise, they are free to can you immediately as soon as you suggest that you are going to leave. They don't have to let you lame duck out your two weeks nor pay you for when you are not working.

    In 49 out of 50 states, the answer is no, you are not due anything beyond the last day you actually worked, regardless of how much notice you gave. In the 50th state, you are entitled to pay to the end of the pay period (which may or may not coincide with your notice) in which your last day of employment occurred.

    When you tell us what state you're in, I'll tell you which state is the exception.

    Indiana is not the exception.

    You live in an at-will state, which means that you can be booted for any reason or no reason.

    My policy, when turning in a notice, is to be prepared to be told "Hey, today's your last day."

    And the state that is the exception is New Hampshire. Since I promised. (and it only applies to salaried personnel)

    File for unemployment. Some states will pay in a case like this. You'll mitigate your loss. Be sure to get the application in before close of business on Friday so that this week counts.
