My question involves traffic court in the State of: North Carolina
Hello everyone,
Recently I received a ticket in the state of North Carolina for speeding. The speed limit zone was 45mph and the police officer issued me a ticket stating that my speed was 59mph. In certain aspects this is good because it is an infraction. Here is my question as well as the scenario: I was driving to my house after working nights shift so it was 7 a.m. and I came up on a moped going 30 mph in the 45mph zone. I had clear visual sight of the road, I accelerated, and passed the moped. After passing the moped I IMMEDIATELY hit the brakes to get back down the the speed limit and at that very moment the cop passed me in the left lane. He turned around in the road and pulled me. Now, the police officer told me that my car crossed the yellow line when passing the moped and he could have given me a ticket for that, however, he only gave me a speeding ticket. The officer stated how much he disliked mopeds, but still had to give me a ticket for speeding. My question is how do I fight this ticket? Is there not laws against going too fast? Does every human being not pass a tractor going 10mph in a 40mph zone? The man on the moped waived me a signal to proceed around him because he clearly knew he was operating at a unsafe speed. Now if I do beat this thing do I still have to pay court costs, because it is over $200 dollars and I'm just a college student. Thanks in advance for any response.
