My daughter and I were in an accident in Florida where we live 18 months ago. We were rear ended by a 19 yr old who's father owned the truck The inpact of being rear ended threw us into another truck causing 2 accidents in one so to say. Both of us suffered injuries to neck and back. Daughter 10 at the time. My arm was later diagnosed as having trouble causing cortizone shots with stiffness and lots of pain. Some call it tennis elbow. I didn't start complaining about this pain for about 2 months because it was not as bothersome but got worse quickly. One year later I had surgery missing a month of work and lost wages etc.
I have a great atty who filed suit against the owners ins company. They say they will not pay for arm injury at all because I took too long to copmplain as well as they think I may have done the injury another way and not the accident. I do not play tennis, softball, anything like that to over use my arm to cause the injury.
I know it is common for the ins companies to fight back and say it wasn't caused by the accident but does this look right to you? I never had a problem with my arm before. It prooves that in medical history. Anyway, now my atty has said...let's take it to court before a jury then. I have heard nothing in a few months and trust my atty but what do you think will happen in Fl? I lost a lot of money on this as well as my car was brand new, not a pymt md yet and I had to bite the depreciation as well as not get the same vehicle because I couldn't afford it again.
Do you think it will go over well in FL courts for my favor or his? By the way, I bought a million dollar umbrella policy so I have extra insurance. Does that help if the driver of the other car does not have more than 100,00.00 policy?
