    Default Do Guest Parking Rules Apply to Tenants Parking in Guest Spaces

    My question involves a traffic citation from the state of: California

    After being towed i took a look at my leasing agreement and its terms of parking and vehicles. I will detail what is says.
    "A guest or invitee shall not be allowed to park at the Community for more than 7 days a month"
    I did not pay for a designated spot so i use the guest parking
    Then it describes what constitutes an "unauthorized or illegally parked car"

    I was issued a ticket by my complex on 12/5 for a "stored or nonoperation vehicle (not permitted on property)"
    My vehicle is operational and i use it to go to college a few times a week. infrequently but it is used.

    They had my car towed on 12/11 which is only 6 days not 7.
    Under CA law my apartments had to give the tow company a date when "vehicle was first observed parked on the property"
    They told the tow company 12/5. This is only 6 days that they have me recorded parked in that same spot.

    The agreement says Landlord may tow, at the expense of the owner, a motor vehicle that is unauthorized or illegally parked at the community or in violation of this lease.
    Towed for being "stored" keep in mind. nothing else. Which says " can't be stored unless regularly used by resident party as means of transportation" which i do use for school a couple times a week.
    Please help

    so, what do the rules regarding tenant parking say about parking in the guest lot?

    Since you are neither a guest nor an invitee, why do you believe a rule concerning guests or invitees cars would apply to you?

    My complex gives each apt one reserved spot then charges $15 a month for any extra covered, reserved parking spots. My roomate uses the reserved spot.
    I choose not to pay that and use the guest lot, and a guest parking pass. The guest lot is a first come first serve basis which is why reserved is obviously more desirable.
    So technically i was using guest parking. But i am a resident and the info above is from the leasing agreement

    so you lied that the pass would be used for a guest?

    first come first serve for whom? Are tenants even allowed to use the lot? If so, what are the rules applicable to a tenant using the guest lot?

    A guest pass vehicle would be subject to guess pass rules. Remember the 7 day a month tow?

    yes tenants are allowed to use the lot. the word guest is just the term they use for any parking not associated with the monthly payments to reserve a spot.
    It is basically open public parking, but you still need a guest permit to park there over night. I did not lie it is just the way the complex works.

    First come first serve to anyone. at 10PM everyone without a guest parking pass must leave the lot. The rules i have mentioned prior are the only ones applying to my situation. the others are things like "blocking another car in" "no tires on car" etc.

    but if the guest pass is not allowed to be used by a tenant, those rules do not apply. The rules that apply to a tenant when using the guest lot are what would apply.

    what specifically are you asking and what did the property management say when yuo asked them about this

    Specifically Asking: The contract says i have 7 days to park in the month. i was towed after a documented 6 days for "storing a vehicle". which is in the contract and where it says "No vehicle may be stored unless it is regularly used by party resident as a means of transportation". I do use it once or twice a week.

    City code says storing a vehicle is 72 hours of nonuse. However our contract says i "cannot park in the community for more than 7 days in any month"

    So the contract is a little conflicting with city code for storing. but it should have higher authority since we agreed upon these terms i believe and signed it. Otherwise that provision of 7 days would be obse

    Please let me have your analysis of this

    I would say a month is 30 days and you misinterpreted it to be a calendar month.

    so, what did the property managers say when you explained all of this to them?

    12/6-day 2
    12/7- day 3
    12/8-day 4
    12/9- day 5
    12/10-day 6
    12/11-day 7


    while the rules state "not more than 7 days", it doesn't take much to think they saw it the 4th as well so, what did they say when you told them it was only 7 days and not exceeding 7 days.




    also note that there is nothing in the rules you are tossing out that says the day count has to be consecutive days. Based on your rules, 4 days in the first week of the month and 4 days in the last week of the month would exceed the 7 days allowed. That would be a good way to apply the rule if it was intended to prevent residents from using the space as a regular parking space.
