amontavon79, this is a hard situation as a step parent, technically, you are was termed a 'legal stranger' Which parent are you married to? If you are married to the father, it would be more difficult to give you advice then if you were married to the mother.
I agree that insulting the father and his parenting skills would be a low strategy for mom. So what I am getting from all of the advice is that she has to prove that the kids living with her half of the time will help them academically. And she needs to have more reasons to show the benefits. I told her to get a lawyer this time around. Even though a few of you were sarcastic I still appreciate your input.
I'm not usually a gambling lass but I don't foresee Mom getting custody unless something happens to Dad.
What's more likely is that he must get on the same page as the school and getting their input.
In other words, he'll get at least one chance to fix things....and that's only if the court thinks they're held back because of Dad versus them just not being as smart as other kids.
