    Default How Long Do The Police Have to File Chlld Molestation Charges

    My question involves criminal law for the state of:Ohio
    A woman was molested from ages 7 to 11 and reported it at age 17. The police wanted her to take a polygraph but her parents would not give permission. Her adopted father was the perpetrator. The police didn't pursue the case any further due to lack of evidence. She is now 35 years old. Can she have the police reopen the case?

    Possibly. Some of the abuse statutes run 20 years from when she turned 18.

    It sees that unless there was reason to toll the SOL, Ohio allows only 12 years in which to file.

    I know the statute of limitations is only 12years from age 18. I didn't know if it is possible to reopen the case because she already reported it. That was my question.

    Not unless prosecution commences. Just "reporting it" isn't enough. Tolling occurs if the accused is avoiding prosecution (fled the state) or if there is another charge pending.

    Depending on what the molestation was, there's still a chance under the longer 2907.03, etc...

    That's really the end of it. Had she not "discovered" it until she was 35 she might have had a slim chance, but since it was already discovered and reported, there's nothing more she can do.

    I'm reading it as it was reported, investigated and closed due to lack of evidence. I'm not convinced she has a chance at all.

    However, a local attorney would be able to give a yes or no answer.

    Would a civil case against the alleged perpetrator be possible or is it too late for that also?
