    Default My Friend is Kicking Me Out

    My question involves an eviction in the state of: PA

    A person whom I had known for 20 years invited me to move to PA with my dog to help her raise her 7 year old son. She is mentally unstable and has had child protection services looking at her case. I had no idea just how unstable she is. She lied about the status of her finances and made everything sound like it would be OK. After moving in last October, I've had nothing but issues from her. I've done nothing but try to help her and her son by cleaning up her apartment which is a pig sty, being a companion to her son, and giving her money.

    At the beginning of December, I gave her $200 which consisted of $140 for rent and $60 for the internet. We made a verbal agreement on that day that I would pay her $200 plus $60 for the internet for the next month. She threatened to turn the internet off and so I called her mother who has been acting as an intermediary. Now, after something changed in her mind, she want's me to go. I have nowhere to go and no job yet.

    Tonight, she had the landlord and his henchman pay me a visit. She didn't tell him I gave her money and the landlord was surprised at that. The upshot is he gave me 10 days to move out. I told him that that is doubtful and I paid until the end of December. I told him he would have to give me written notice and he said that I would get them in the morning.

    What are my rights? I don't think they can lock me out. If he gives me written notice and I have nowhere to go, will he have to legally evict me? I would happily move out except I have nowhere to go.

    I can't see her lease from where I'm sitting, but it sounds like the lease prohibits long-term guests. Read it and find out.

    Her landlord can evict her if she violates the lease, or perhaps charge her for the additional resident if that's what her lease provides. He can authorize her to change the locks, but she's your landlord and you can sue her for wrongful eviction (not that she's likely to have any money to pay a judgment).

    Are you saying that her landlords' notice is null and void because I'm her houseguest/tenant and not his tenant? He definitely doesn't think this is the case, LOL. I have no access to the lease. My biggest fear is they will try to put my things and dog out in the cold when I'm not there and change the locks. I'm actively looking for a place so it may not come to this. This woman is a pure psycho. I don't mean to say that I'm pure as the driven snow, but I'm hoping there are some laws that back me up in PA.

    I said exactly what I said, nothing less and nothing more.

    A landlord can evict his tenant for violating her lease. Your friend, however, is your landlord and is the one responsible for ensuring that your rental agreement with her is honored.

    She may well put your belongings and dog out in the cold, and change the locks. And again, from what you have said it does not sound like she has money to pay a judgment. You may well find that your best path forward is to find a new place to say, ASAP.

    So, he hasn't given me anything in writing as of yet. And MAYBE that is because my rental agreement is with her and not him, right?

    Just so I'm clear on this; he can't evict me because my contract/agreement is with her, right? Only she can authorize him to change the locks, right? So, does that mean that the verbal ten days notice he's given me are just empty words with nothing legal to back them?

    In the state of Pennsylvania you are now a tenant, whether you pay rent or not. The landlord or the person renting the apartment will have to go to the District Judge and have you evicted. Until then enjoy your stay.
