    Default Does Court Ordered Holiday Visits Trump Vacation Requested at the Same Time

    My question involves a child custody case from the State of: NJ Each parent has been given through a court order, split holidays every other year. This Christmas I have child 6pm Dec 24 until 12 noon Dec. 25. The other parent has scheduled vacation time during the holiday. Each parent is allowed vacation days, but does that mean I will lose this holiday seeing my child? I live 1 mile from the other parent so it won't be a problem for pick up or drop off. I am reasonable to understand if they are scheduled to be out of the area, then that would be ok. I have been careful to not schedule vacation time over a major holiday. Child has been told of vacation time and is upset about not being able to see me. Child is 13, if that matters and is not aware of any plans. I do understand if reservations and travels plans were made, then that is the way it is. Thanks for your time.

    In most states holidays trump requested, summer vacation time, but your question was swallowed, so i'm not sure if that's what you were asking

    Thanks that is what I was thinking too, but trying to gain some information before I bring up this up as an issue. I guess I'm a little dim, but not sure what you mean by question being swallowed. Hope I was clear, maybe not. Thanks for the info.

    Pretty much any judge would take a very dim view of a parent who attempted to schedule a vacation during the other parent's allotted holiday time. In fact, I think that pretty much any judge would hand them their backside for doing so.
