Can You Get Emancipated if Your Parents Threaten to Throw You Out

My question involves juvenile law in the State of:north carolina

Hello. I live in North Carolina and i am in a tough situation where i am always being threatened to be kicked out the house. I turn 16 in two months and would like to know if emancipation would be a necessary option and if so how to do it. I went on a few websites and was told if i get married join arm forces or go to court that i could get emancipated. But to get married you would need your parents permission. And i thought you would have to have a guardians permission to join arm forces too. Please help.

You are not even close to being a candidate for emancipation or obtaining your other thoughts. Before you think about getting knocked up, legally it means you need more supervision, not less.

no one said anything about getting knocked up. How about you explain why i am not a candidate for getting emancipated and ect. I plan ahead if its the age thing.

How long have you been living completely apart from your parents and how long have you been supporting yourself 100%? Oh, oops, you still live with them and are still being supported.

The law is here, and you'll note that it discusses NEED for emancipation. You - like every other teenager in existence - think your parents are unreasonable. They've probably said "My house, my rules. If you don't like it, get out.", and you want to say "They're kicking me out!", when what they're really saying is "Get it together, kid."

You don't NEED emancipation. You WANT it, and that's not going to hold any water with the courts.

No i do not think that. Tbh i am not living wih my parents. I did not wish to put all my business out there.

Emancipation, in the very rare cases that it is granted, comes into being when the minor is living on her own and paying 100% of her own expenses. That does not mean living with a friend or relative and paying a token rent; it means that you are paying the full market rate for rent in your area; utilities; food; clothing; medical care; insurance; transportation; staples; school fees and supplies; and all the other incidentals of life, while still going to school and getting better than average grades. If you are not doing this, then you are not getting emancipated. I don't care what you came on the website to hear - that is the legally correct answer.

And you are right; you need parental permission to join the armed forces or marry.

There is no easy way to emancipation. It's hard. It's supposed to be hard. It's intended to be hard. Emancipation is not going to happen except in the most extreme of cases. Nothing you have posted so far suggests that you are in any way qualified to be one of the extremely few (think 1% of the minors who apply) who succeed in having the court approve your emancipation.

Then surely you read the stickied threads, and thus also the laws of your state for emancipation. So help us out here, and tell us about how you propose to convince a court that you have an actual need for emancipation, how you will prove your "ability to function as an adult", how you will prove a stable and reliable source of income sufficient to fully support yourself, how you will prove the "stability of the [your] living arrangements", your "proper and lawful plan for adequately providing for the [your] needs and living expenses", how you will convince the court that you "fully understand[] the ramifications of" emancipation, how you will convince the court that emancipation is in your best interest, and anything else you think might be persuasive in court.
