Yes, the stuff that belongs to the kid, is going to the kid. Unfortunately, 2 of his instruments are in a repair shop and might not get out in time to meet the court order. I'll get a note from the repair service.
Do I just word the motion in the same format as what CPS did, but from our perspective, and submit it to the Assistant Prosecutor as CPS did?
CPS is also creating a roadblock in our receipt of school & medical records, so I figured I'd file motions for that, too. And they cancelled the psychologist I had for him on my insurance and set up an app't with a licensed social worker at a practice that takes medicare. Unfortunately, they didn't get that app't until after he OD'd. I just realized I can petition the court for an order to use the doctor I selected, court might not order it but at least I'll have given it a shot.
I have a lawyer who will advise for $225/hour, but I was hoping the motions would be explained easily enough that I could ask on this forum. So far, so good.

Sometimes we don't know what to ask for, but reading some of the replies on this thread & forums helped me. I did a search for forms & our county name & which court. More specific information came up. A motion will be considered based on the information on the motion and an affidavit of memorandum(sorry if I screwed that up, I've got it saved in another doc already), UNLESS an oral hearing is requested. I'm going to bypass the oral hearing.
