    Default How Will Retail Theft Affect Employment as a CNA

    I am currently a CNA, working in an rehabilitation home. When I was hired, my background check came back clean. I recently was given a citation, Misdemeanor 1, "Retail Theft," now my question is, will I be able to continue working as a CNA, with it just being a Misdemeanor 1? My question involves labor and employment law for the state of: Pennsylvania

    Depends on your employer. Generally speaking, they don't want you to have any felonies or any charges that deal with child or elder abuse or sexual offenses. Some employers want a completely clean record. You'll have to check with yours.

    I did not think a misdemeanor would affect your position. I explained to my supervisor the situation, and even she was unsure if the board would allow me to continue my employment. Since it is only a Misdemeanor 1, I should not have any problems continuing employment, since it's nothing higher?

    Nothing in PA law says that as long as the crime you committed is "only" a misdemeanor, your employer is required to overlook it. In fact, PA law treats felonies and misdemeanors the same, where employment is concerned. A misdemeanor is still a crime.

    What will matter is not whether or not your crime was a felony or misdemeanor, but how closely it relates to the job.

    Depending on the state.....Michigan, for an example, state law - you cannot even work as a janitor or waitress in a Senior Center (crime of moral turpitude, working around vulnerable populations)

    Lets approach this from a logical standpoint. Would you, as a health care employer, employ someone who is likely to steal from your patients?

    It also depends on your state law. In Michigan, for example, a person with a retail theft misdemeanor cannot even work as a Food Server in an Assisted Living Facility - by law.
