    Default Defending Against a Speeding Ticket by Claiming the Recorded Speed is Wrong

    My question involves traffic court in the State of: Washington, City of Clyde Hill, King County

    First off thank you all for the work on this forum. I appreciate everyone who provides such valuable advice. I have been successful in the past using the tips and information here.

    I am a bit at a loss in my current situation as to proper arguments and my court date is tomorrow. In the past I have found egregious errors or was not given timely discovery etc. In this case I am at a loss and appreciate any advice. I was stopped for speeding early in the morning. I believe it was fishing for a DUI. In any case I wasn't speeding. Certainly not as stated.

    I of course realize that I need a solid defense and not hearsay.

    I have attached the discovery response including the officer's statement and a copy of the ticket.

    The ticket was issued on 10/10/2013 and filed with the court on 10/17/2013.

    Does anything stand out ? Thanks so much for the Help !

    You say, "In any case I wasn't speeding. Certainly not as stated." Those two statements are not consistent. If you weren't speeding, the second statement is not necessary. If you were speeding but not "as stated", you were speeding. "I was speeding, but not by that much" or "I am pretty sure I wasn't speeding but don't know how fast I was going" are not particularly compelling defenses - do you have anything more for us to work with?

    I was consciously driving slowly as I recall seeing people stopped on the particular road I was on often... I recall being surprised to be pulled over. If I were speeding it was maybe 5 over. In any case I am NOT asserting my opinion or recollection would be in any way a valid defense.

    As the officers sworn statement is likely the entirety of the evidence that the prosecutor will have (typical in washington) I Was wondering if there was an inconsistency or oversight that I am missing. I.e. There is no mention of the mode the radar was in (Moving vs. stationary) or that the officer did not note the speed he was traveling etc.
