    Default When Can Married People File as Single

    I am a green card holder and my fiancé is a non resident living in his home country where we will be getting married. For personal reasons we would prefer to file as single. Would this be possible at least just for the first year of marriage? During the first year he would be in his country while I finish up my work before moving there.

    You have two options:

    Married filing jointly, or married filing separately.

    Which of these would benefit you most, we cannot tell. It will depend on your circumstances.

    And to expand on what doggy says, if you are married on December 31 of the year you are considered married for the year and must select one of the married filing options. Doesn't matter where you or your spouse are or what her residency status is.
