Arrested for Public Intoxication Inside of My Apartment Complex

In many states it is legal for LE to say, "would you please step outside" and then, when you comply, to arrest you for public intoxication. It's an ugly little trick they can legally play.

If "outside" is on the public street or private property where he is not permitted to be. In Georgia, the public spaces of apartment buildings and likes are NOT "in public" but are extensions of the private dwellings on which they are located.


As pointed out, he was noted coming from the public road and the officer is free to inquire at a persons residence if they violated the law out in public. There's not even a requirement that he have a reasonable suspicion. It's a permissive stop.

I was not noted coming from the public road. the officer didn't see me from the gate. It was the middle of my apt complex.

I miss the part that if the apartment complex is belong to public or private property.
If I'm guilty and wrongful, how can attorney help me? It seems you say I'm guilty and there's no way I can get out of the situation.
