    Default Does Child Support Change if the Custodial Parent Moves Out of State

    My question involves child support in the State of: CA/CO/OR

    The custodial parent established a child support order in CA in 2011. I live in CO. Custodial parent is permanently moving to Oregon this month. Will the CA support order still stand, or can I request a modification? Also, can she legally move out of state without notifying me?

    She's obviously notified you.

    Child support won't change except for Oregon enforcing the CA order.

    Were you under the impression you can modify based upon another state's rules?

    She did not notify me. I was told by a mutual friend that she was moving. I am under the impression it would change since she would apply for public assistance in OR, therefore a child support order may be ordered again.

    If anything you're going to be paying more...the state will want their share before Mom.

    The bottom line is this:

    Even if Mom didn't officially notify you, California presumes that relocation is in the child's best interest; in other words the burden of proof is on you to show that the move isn't in the child's best interest. You're already in a different state; the court can't really spank Mom too hard.

    Child support doesn't increase based upon an application for public assistance, but should be paid to the state before mom. With this being an interstate case, dad needs to be careful in case mom doesn't tell the public assistance agency that she's the beneficiary of a child support order from another state.
