    Exclamation Being Bullied on the Job

    My question involves labor and employment law for the state of:kansas





    I have recently been denied unemployment benefits after i was fired from the job. I feel i have been bullied by coworkers and honestly don't know why the bullying began on a Monday morning. a few of my coworkers treated me rudely in an unprofessional manner. We are certified nurses aides.we are on the bottom of the totem pole, but we are still required to act in a professional manner. To treat each other with respect and kindness. We may or may not like each other but we still have to work with each other for X amount of hours a day. I felt like i was in high school being talked about, rumors spread about me, snide remarks within hearing distance. It mad me feel uncomfortable. I went to my supervisor to let her know i was uncomfortable with my coworkers. My Supervisor said they were just having a bad day. The harassment and bullying went on all week. Everyday that week i went to the next in charge supervisor. and they blew me off. On Friday, the coworker and i was called into the administrators office. The other coworker sat there for at least 10 minutes berating me, belittling me, and said i was a worthless excuse for an aide. the administrator sat there and listened to the coworker say all these things to me. i was quiet until she attacked my personal character. I knew better than to do this, but i stood up and told the coworker that it took everything i had for me not to jump across that table and beat the **** out of her. Im not a violent person by no means, i just had enough of being talked down to as a person. immediately after i made that statement, the administrator said we were both put on suspension. I knew i was in trouble. that afternoon, i was told over the phone that my employment was terminated, with no verbal reason given as to why. About a week ago, I looked at my facebook and saw someone i worked with had messaged me. I don't associate with this employee other than working a shift with her. She told me she heard about why i got fired. she typed word for word about what was supposedly said in a private office. This was put on a public website open to view by anyone. Its embarrassing to my character. what can i do to win my appeal? i had no previous warnings from this company about this subject. and i liked my job.

    You basically threatened to harm another employee - and did so with witnesses. This can equate to willful misconduct, which does generally preclude you from collecting UI.

    You can of course appeal, but I don't rate your chances too highly.

    I did everything i could to solve this issue myself before going to a supervisor with my problem. Nobody listened or cared. the administrator sat there and just listened to this girl talk trash. and i felt about an inch tall. so i defended myself.

    I understand that. But your response was inappropriate. The supervisor may have seen things differently; the other woman says her piece, and you respond with a threat.

    See where I'm coming from?

    most likely there is nothing you can do except hope the employer has better things to do than show up, workplace violence is a very serious matter in all 50 states.

    I understand that. im not a violent person. but my employer let the bullying go on without no intervention. so in my case, do i just let coworkers harrass me and hope i keep my job?

    There are ways of coping with bullies. Threatening them at work isn't one of them.

    There's a whole lot of space too, between letting coworkers harass you and threatening them.

    its a hostile work environment. I have asked for help with this, but recieved no help. it affects the residents also.

    It was called:

    listening to their side of the story. I would have expected, had you not got all threatening, you to be given a chance to respond after that person was done talking.

    No, it's not a hostile work environment.

    (That has a very specific meaning under the law - people being mean to you doesn't qualify)

    But even if it was a HWE, it STILL doesn't give you the right to threaten bodily harm.
