    Default Father Opposes Reloction of Child so Mother Can Attend College in Another State

    My question involves a child custody case from the State of: Tennessee. I am 20 years old and the father of my 2 year old is 19 years old. We never married and had a parenting plan in place. I got him to agree to a new parenting plan in July 2013 that would accommodate myself and my son to move to Kentucky for me to attend college. 2 weeks away from moving and I got a summons about me having to stay here until the court date(January 15, 2014) for a new parenting plan. My classes start January 13th I wanted to get my son acclimated to the move and start him in Day care before I started school. Can he stop or delay me from moving even though he already signed and recorded the new parenting plan with the courts back in July 2013?

    He can change his mind, yes - apparently that's what he's done. Whether or not the Judge will rule in his favor, we cannot guess.

    Have you spoken to Dad about it?

    If you already have a new plan recorded with the courts that accommodates a relocation for you and the child, what is dad objecting to now? Is he attempting to challenge the move after already agreeing to it, or is he wanting something in the plan changed?

    He is saying he can get full custody. Our conversations are not kind or productive. He doesnt want our son to be in day care, although the pediatrician wants either daycare or speech therapist due to being delayed in speaking clearly. He lives with his parents and they have all moved out of the house due to foreclosure and he will not let me know what address my son is staying at every other weekend. I believe he is trying to keep me from moving. He still believes that we can get back together and be a family even though we have not been together for over a year now.

    a revised parenting plan stating the meeting place for exchange, the days and times that that would oocur and everything else staying the same.

    Revised parenting plan was given to them and they had both of us sign it in front of the clerk of the court and it was notarized. He gets the child every other weekend from Thursday 6pm to Sunday 6pm. And the exchange point is closer to him than myself.
