    Default Landlord Won't Help Evict Problem Roommate

    Hi, we are on a month-to-month lease. I read your forum and found many useful advice. However, the landlord refused to help give us a "Notice to Quit" and to renew the contract without the problematic roommate due to "not having just cause". The roommate threatened my boyfriend over an argument, he said "I will hit you. Do not put words in my mouth. I will hit you."

    All 3 of us reside in one apartment. My b.f. and I don't want to live with a violent person. Is a verbal threat a just cause for eviction? We already opened a file with the police in case something happens. Will the landlords get in trouble if we came to them with a serious issue like this and do not receive help? What will it take to change the terms of the agreement since it is a month-to-month contract so that the problem roommate is on sublease instead of being a cotenant?

    If you're on a month-to-month tenancy, you can give your landlord one month's notice (or one full rental period, depending on your state law) and move.

    We thought about that, but we didn't want to move because we came in first and lived here for many years more than he (the roommate) did. Honestly, we don't want to move because we have a lot of things and he has just his one room belongings.

    There really is no way of kicking him out?

    You can explore the possibility of getting a personal protection order, if the facts would warrant the issuance of such an order.
