My question involves juvenile law in the State of: michigan
If a person has two charges on their minor record that would have been felonies if they'd been adults, and as an adult are charged with a similar crime, will the prosecution look at the juvenile record and consider you a habitual offender?
I'm just looking for insight as to what kind of time my ex is facing (i am trying to gain custody of our child together).
She is currently in jail for assault and battery on a 17 year old, awaiting her pretrial confrence. she has not bonded out. she's been in for a little over amonth.
She is 22 and has 2 priors on her juvenile record. i thought they were from when she was 16 and 17. i'm not 100% on her age at the time. it was right around when we started dating. she was 16 when we met. they may have both been age 16. cuz she was never tried as an adult. anyways, one charge is assault with a deadly weapon (went after a girl with a knife, but didnt actually hurt her, more of a threat) and also assault of a police officer. it may have been assault and battery of a police officer because she did physically hit him, but they might have brought it down on a plea.
she was physical to me also during our relationship. always punching me and hitting me. but we were young and i never called the cops on her, it wasnt like she was beating me, i was much bigger than her. so i just always let it slide. so its not like i can bring that up in a custody battle.
