    Default Traded My Car for a Stolen Car

    My question involves a consumer law issue in the State of: I swapped my mini for a mercedes on popular swapping website. After the swap had been done, I noticed that the log book looked different to what I had seen before, so I went on the net and checked and it appeared that the log book I had in my possession was one that the DVLA had deemed as stolen so, I called the police over fears that my newly swapped car had been cloned/stolen and the police came out and did indeed confirm my theory that I had in my possession a cloned car. So the Police took my new car away and had supposedly marked my previously swapped car as stolen. I was checking the usual car selling/swapping websites and after 3 weeks, I found the original mini I had being sold on Gumtree, so I immediately called the police and told them where my car was. They informed me that as the car was no longer in possession of the people who had given my the cloned car and was now in an innocent purchasers hands that it is now a civil matter. What can I do?

    the state of: I swapped my mini Would that be closer to the east coast or west coast?



    What can I do?
    you sue the guy that you swapped cars with.

    I can't sue the guy I swapped it with because the car has been reported as stolen and I dont know who he is and he has already swapped it with another guy whoi will not give it me back but he has been issued with a section 66 which means he can't swap/sell it for a certain amount of days but the police have said their legal team have deemed it a civil matter because the guy who has it now, swapped his car for what was mine, in good faith

    irrelevant

    but realistically, he did not steal the car so if it is reported stolen, it is not a valid charge.

    You don't know who the guy you sold your car to is? How about it's the guy whose name was on the title of the car you got in exchange?

    that is why you have to sue the guy that ripped you off.

    but let me guess;

    you met in a shopping center parking lot, you never saw any ID from the guy, it wasn't really his name on the title,

    Yes all the above is correct and even though I had my reservations, the car I swapped for was better than mine and the greed took over.

    if the deal sounds to good to be true, it probably is.


    good luck finding the guy. Hope you have something to help you. I would start with the folks that have your old car. Unless the guy did a little title jumping (actually I am betting he did) his name and info was on the title they received. Maybe they got more info about the guy than you did and it will help you track him down.

    You swapped your car, for another, more expensive car, without first ensuring that it wasn't stolen? Show me the car fax.
