    Post Can a Used Car Dealership Repossess Your Car if They're Not the Lender

    My question involves a consumer law issue in the State of: Arizona

    I purchased a car back in sept and I paid 500 as down payment the dealer told me when I get a call for the company that is going to finace my car to tell them I paid the full down payment, which I did. He then stated that if I don't make payments on time with the finace company they can repo my car which I understand (makes perfect sense). Since sept I have been making different payments to the dealership to finish paying the the down payment they told me to tell the finace company I completely paid. In oct I lost my job so I was unable to pay my nov payment too the dealership on time. The dealer and his general manager then stated that they are going to repo my car because they have a gps on my car and buy the car back from the bank because I missed my payment that I have seperate with them. Can they repo my car? And what options do I have?

    Consult your contract and finance agreement with them. It appears they have a secondary lien. Your recourse would be to pay them as you promised quickly.

    also you are not in a good position to make noise about this, you and the dealer conspired to defraud the finance company

    This is not a good position to be in. Since they know you are not working they are not required to extend you any additional time to make payments. You would think they would work with you but they are not required to and that is the big problem. They loaned you money on the premise that you can pay back because you have employment. Without that you can't show that you can afford to keep making the car payments and insurance. Also you are dealing with a used car dealer and you may have heard they are not the most sympathetic people in the world. Take the time to read thru your contract. If it has a lot of language that is hard to understand then that means the contract is very skewed to the lender and seller. You may have signed away certain rights that your state has to protect consumers. The best thing you can do is to have employment. Without it they will take the car.
