    Default When Do You Have to Repay a Loan

    My question involves collection proceedings in the State of: California

    My mother loaned me 100K for a business that she was completely for, she handed over the money i cashed the check, suddenly after weeks when i gave escrow the deposit and racked up attorney fees and other filing fees which was paid with the money she loaned me. She wants her money back and wants it really bad she threaten litigation, which i dont even understand what can she do? i tried to explain i'm willing to pay back the money, i stated that many times and even though there is no promissory note, i am still willing to sign one even though she gave me the money already. Can i sue her for damages? and attorney fees? if she takes me to court?. i wish i never borrowed it at this point.

    I thought you borrowed $150,000.

    Who is suing you, for what, and did your mother know that you were going to spend the money on your lawsuit?

    Why do you imagine that you could sue your mother for asking you to repay money that you borrowed?

    My mother threaten to sue if I didn't give her the money back and cancel the deal.

    She decided to back out the deal when in escrow causing all these fees to stack up.

    I don't want to sue her but if she sues me for the money. How is this fair? She agreed to loan me the money with no paperwork. And I would like to pay her as we agreed. She was ok with everything so there was no paperwork. And I don't want to cancel the deal and stay with all the fees that need to be paid including deposit.

    You have no grounds whatsoever to sue her. She, on the other hand, may have grounds to sue you.
