    Cool Landlord Says That We Cannot Move in on the Agreed Move-in Date

    My question involves landlord-tenant law in the State of: New Jersey

    My husband and I have signed a lease to move into an apartment on 11/27 and we have already terminated our current lease to move out on the same day.

    Yesterday (11/22) we received an email from the property manager saying that we will not be able to move in until 12/3 because the inspector doesn't have time to check the apartment. She didn't offer any solutions for our current situation. I know there is no way we can extend our current lease bc the new tenant is going to move in on 11/27. At this point, can we ask for hotel/storage/transportation expenses to be covered by our new landlord? Are they bound by laws to do that because they break our lease?

    Any advise would be appreciated!!!

    ask them if they are going to pay for your temporary stay in a hotel by cash or check.


    then ask them if they are going to provide storage for your personal property and if they are going to provide the movers for the move from storage to the apartment or it you have to arrange all of that yourself and should you have the bill sent to them or are they going to reimburse you.


    The payment methods in that are more to put the LL on notice you expect them to pay for the added costs more than a true request for an answer. More often than not a LL would reimburse you upon presentation of receipts.


    They are as bound by the lease as the tenant is. If you have a possession date of 11/27, then that is when they are obligated to provide housing for you.

    You can "ask" for anything but if the manager says no, you find yourself a place to stay, you find a place to store your stuff, you keep receipts and records, you move in on 12/3 (photographing every inch of the place), and THEN you turn around and sue the apartment owners for your expenses in small claims court.

    There may be a provision in the lease relating to what happens if the premises are not available on the agreed date. Please review your lease and share any such provision with us.
