    Default Billed for Unpaid Tution Despite Paying Off Student Loans

    My question involves collection proceedings in the State of: Michigan

    I attended Oakland University back in 2002. I paid all of my student loans in full. However, ten years after attending the college they allege I still owe tuition fees of $700. I was never formally contacted or made aware of it on my credit report. So they took action thru the state of Michigan treasury agency and diverted my state tax refunds to the tune of over $1200. Its tricky because the collection ageny which is subcontracted by the state of michigan is also involved. My question is what is my recourse to recoupe this money if any. And are they in direct violation of the fair debt collection act if a collection agency is involved?

    You should investigate whether you do in fact owe the money.

    the first thing to do would be to research this issue.

    what do you believe may be in violation of the FDCPA?

    Most government debts - including taxes and government student loans - can be enforced without the government needing a court order although you still need to be notified.

    You use the term "formally contacted". Does this imply that you were contacted at some point?

    Have you moved? (In other words might you have been notified at an old address?)
