    Default Adverse Possession in Texas

    Hello, Im new here and would like some advice on a situation my parents are in. Any insight will be very much appreciated.

    My grandfather owned a condo in texas. he died in 1992, without will and testement. he had a wife and an adopted daughter, also my mother who would be the rightul heirs. the wife and adopted daughter sold their share of the condo in 1993 in houstan texas without my mothers consent. my mother didn't even know that she had interest in the property until july of 2006. it is in my opinion that the purchaser deliberately withheld the information from my mother in order to claim adverse possession. i currently have just obtained my real estate license in the state of hawaii and i have knowledge of adverse possession in hawaii. i am not sure of the legnth of time by which one can claim adverser possesion in texas. it is 10 years i believe. the purchaser is an attorney in texas and waited 13 years to inform my mother about her share in the condo which is supposedly 18%. which i believe to be unethical for a lawyer.

    if adverse possession is open and notorious, for all to know. what if my mother had no idea she owned the property. can ge still claim adverse possession even if she was not aware the propery existed?

    also i think the purchaser bought it as an investment property, whereby he rented it out and now wants to see it. is my mother entitled to any of the profits of the renters.

    the purchaser is trying to obtain clear title and wants my mother to either sign over her portion to clear title or he is going to take us to court.

    is there anything we can to do combat this? any advice?

    Your first step is to get a copy of the grandfather's probate file from the court. Second step is to get a copy of the deeds from the registrar. You can order the probate file over the phone. You may need an attorney to do a search of the title and send you the info. Then take the paperwork to an attorney for an opinion.
