    Default Not Eligible for "Re-Hire"

    My question involves labor and employment law for the state of: NY

    It has been many years since I worked at Bank of America. I loved my job, was getting many accolades, but had the misfortune of being caught in scary politics. I was written up for behavioral warning twice in my performance review. Following that I filed an EEOC complaint. A month after that, I was given another behavioral warning and my employment was terminated on the spot. Months later EEOC dismissed by complaint giving me a right to sue. EEOC confided to me, that my case is very complicated and they dont have the time to pursue it. And I did not avail the right-to-sue since I wanted to move-on with my life, costs associated etc.

    I'm doing pretty good now, but I love the idea of going back to BofA and this time having learnt from first-hand experience, to set things right and reclaim part of my life that I feel to have lost.

    One problem I am not eligible for re-hire. Any ray of hope for me? like laws changing that would compell BofA to change their re-hire flag policy?

    No. There is nothing anywhere compelling a company to hire anybody, let alone a person that has been terminated, especially one that has a "not eligible for rehire" notation on their records.



    time to look elsewhere.

    ??? Well, its not about time to look elsewhere. Its the opposite, its about being tired of why I looked elsewhere. Immediately after being terminated, I secured a position at 1.5 times the compensation as I was earning at BofA, and today I am the least 2 grades above of where I used to be, and more than twice that compensation. I am not sour. But I am competitive. I can get any job I desire, and thats my issue, that I cannot get what I have lost.

    There has to be a way, as I am not alone, you do a google search, BofA is notorious for giving no-rehire flags. It is notorious for coming up with 'insubordination warnings' when people stand up for themselves.

    so what? They can do whatever they want to regarding this. Until we have a form of government that allows the government to control private enterprises to such a degree as to enforce what you want, you are stuck with BofA policies.

    Given you want to brag so much about yourself, you surely should be able to sell BofA on your value and get them to rescind the do not hire designation. While there is no law preventing them from applying such designation to you, there is also no law preventing them from rescinding it either.

    There are no laws anywhere in the US regarding eligiblity for rehire. There is no law you can invoke that will force BofA, or any other employer, to require that you be considered eligible for rehire.

    I don't know how to put it any more clearly than that.
