    Default Working as a Nanny After My J1 Visa Ends

    I currently live in USA and I work as an aupair. I have J1 visa (this is my second year) but my contract with the family is about to expire next October. I got very close with the family and I would love to stay and work for them after my contract. They offered me to stay as a nanny and still live with them in their house. My question is what I should do now? I think first apply for changing status from visitor (J1) to ...? Where to do it? In Embassy? Where to send the proper papers? And what's then? Who should we present contract? Should we write contract by ourselves? Where do they would need to go with ther bank statements and proof I worked for them 2 years?

    I've checked its not gonna be B1, I was thinking about extending J1 (but then I need to show that for ex. I will finish school later than I thought), I am thinking about H2b but its tricky and difficult.

    I really don't know where to start and I know it takes time so I would like to start collecting all the documents now.

    An H-2B is the only legal way. The family must obtain an (EIN) from the IRS, to give to the DOL and USCIS on the H-2B application. The family must file an ETA Form 9142, Application for Temporary Employment Certification, with the U.S. Department of Labor (DOL). After approval the family must file an I-129. After I-129 approval, a change of status, in which you file all paperwork directly with USCIS, may be possible. There is a limit of 66,000 visas p/year.

    Thank you so much for your reply. I will do the research about what you've told me. Do they need to cover anything? I mean I know that you need to cover some changing status fees (I want to do it) but do they need to pay anything? Like a sponsorship, anything?

    I understand if they terminate your employment they must pay your way home. I believe that is the only hidden fee.
