    Default California Probation Violation

    I am a 22 year old living in California. A little over 2 years ago, I was convicted of a DUI and put on 3 years of informal probation. I did the required classes, and paid off all my fines. A few days ago, I was arrested for being drunk in public (647(f)). I was released in the morning. I have not driven since my DUI, and never use illegal drugs. This was just a crazy night where I drank too much, too fast.

    My questions are these: What are my chances of doing jail time? What am I looking at in terms of fines? I was planning on moving in January since I was just accepted into a university in a different county in California. Can this still be possible?

    I am certainly guilty of what I am being charged with, but I am just trying to get my life together, since I seemed to be on the right track (as opposed to 3 years ago). I cannot afford an attorney, so I am just trying to get some legal advice so I can know what to prepare myself for. Thanks for any help.

    You should consider getting a sign-in sheet for AA, and attending a lot of meetings (and getting the written confirmation of your attendance), so you can demonstrate to the court that you are trying to get your alcohol problem under control. You may be able to get your probation transferred to a different county, or work out reporting that doesn't interfere with your schooling, and can discuss that with your probation officer. But you realistically need to resolve your probation violation first.

    Thanks Mr.Knowitall. Do you know what my chances are of doing jail time? How about a steep fine increase? Should I go to AA before my arraignment, or wait until after? Thanks.

    Any time you violate your probation you risk jail time. I'm not in a good position to estimate what your sentence will be - I'm just suggesting steps you might take to minimize the sentence or even continue probation. It's never too early to start AA - and if you can accept that taking the twelve steps will be for your benefit, not just to please a probation officer, all's the better.
