My question involves a marriage in the state of: Alabama
Hi all.
I separated from my husband in May of 2012. That fall (around September I think?) he agreed to file mutual consent papers, but backed out at the last minute. (This was in PA at the time). At the beginning of this year, I moved to AL and in October I filed the divorce complaint. Received a letter about a week ago, saying that a date for trial had been set. When I got a copy of his "answer" it was basically that he wouldn't consent to the divorce for theological reasons and he refuses to pay court costs. Oh, he also wants the engagement ring back.
I'm honestly fine paying whatever additional costs *IF* it doesn't have to go to trial, and I have no problem sending him the ring. Also, he lives in PA and barely makes more than minimum wage, and has all but flat out said he has no way to come to the trial in January. So my question is, if I can talk him into settling by giving him back the ring and agreeing to pay whatever additional costs, can we avoid going to court? I just want this over with ASAP. Thanks.
