    Angry Trying to Complete Adoption of a Child in My Care

    I will make this as breif and concise as possible.
    I live in Texas. I want to adopt a child who is now 13 and has been living with me for 11 years.he is not related to me by blood.
    Here is the story.
    I was operating a homebased daycare center. I had been keeping this baby in my home for about 9 months. He was living with a family friend at that time. The friend got to where she could she could no longer take care of him and gave him back to his maternal grandpa. ( mom had abandonded him at 1 mo old and dad was in prison)
    The granpa did not want him anymore so I called the granpa( who I had never met ) and asked if we could have him, I wanted to adopt him, because I was already very attatched to him. He was 2 yrs old then. The granpa (who had never even met me) broguht the little boy to me at dropped him off and left. He has only seen him 3 times sinse then and the last time was 6 yrs ago. We tried through two different lawyers to adopt him but have had no luck. The bio mom has never been back and the dad is still in prison and refuses to give up rights. He wasnt the boy to go live with his mom who has nevr met this child before. we have spent 12000.00 trying to adopt him but cant find a competant lawyer to help us. we have never even been to court over this.
    We gave up on getting to adopt him but he relly desperatly wants to at least change his name so that it is legally our last name. He is now 13 yrs old. Is there anything that can be done to help us?

    What was it that prevented adoption when you went to court?

    If the babies father and mother were never married you may want to look into the “Paternity Registry”, Statutes: Tex. Fam. Code Ann. sec. 160.251 et seq. This is the Putative Father Registry, Bureau of Vital Statistics
    Texas Department of Health, Tel: 1-888-963-7111, ext. 7782 or 512-458-7782. My opinion looking at it from the fathers side is, he may think that signing adoption papers meens he and his family may never see the child ever, even if he cleaned up his act. If I were that guy I would agree to the adoption on the conditions that the child is never hidden from me or me hidden from the child. If the child sees his birth father in a prison environment, that may very well help in pointing the childs moral compass in the right direction.

    Texas doesnt recognize a fathers ignorance of the registry as an excuse for not registering.

    If the birth father was not established in an Administrative process or registered with the Putative Father Registry he will likely have less rights than the adoption petitioner. This registry is in almost all states and most unwed fathers are unaware of it. I am a Canadian unwed father of two kids in Ohio. The mother of my kids remarried and the guy tried to adopt my kids. If it wasnt for the fact that I had been visiting my kids and voluntarily payed support the adoption would have passed. When they got remarried they stopped all contact between me and my kids. The adoption was dismissed and I still have had no contact with my kids. Iam considering a civil suit on the grounds of conspiracy and parental aleanation, once I get visitation and support established.
