My question involves child support in the State of Texas. My children live with me in Texas. Child custody is joint. Child support orders were established in Texas.
My ex moved to Arizona before the divorce was final.
My question is: If the NCP has moved far enough away and is not participating in joint custody, can his child support payment amount be increased? My reason for this question is: Joint custody would require him to provide for the children while in his care. He would be providing half of the meals, utility costs, everyday needs and spending money. Since he lives in Arizona and does not see the kids but maybe 1 or 2 days every few months, those costs are not split, I now pay 100% of them without additional support from him.
Another question is: If the NCP has moved out of state and his salary has increased, can his child support payment amount be increased? Once again, my reason for this question is because he does not provide additional support beyond state required child support.
