    Default Can I Break My Lease Over Threats From My Neighbor

    We live in Wyoming.

    We rent the upstairs of a house, the guy downstairs (living with his girlfriend and 4 year old) lives in the basement. He moved in about 3 months after we did.

    A week ago I called the cops for loud music after knocking on his door multiple times. He was ticketed for smoking weed. The next day I called the cops again because he was smoking weed, but they took a while to get here and didn't have enough proof to ticket him again. That night he stood outside our bedroom window smoking with a friend of his, talking about breaking into our house the next time we were gone. The next morning at 6am a cop knocked on our door (the same one that was here the day before) and said the neighbors called for a child welfare check. He disregarded the call upon seeing our happy children. He knew it was retaliation from the neighbors. He also recommended I call the landlord about the drugs and the threat.

    The landlord did NOT evict them, even with police reports of his drug use. He also doesn't want us to leave. Our lease is still active until June of 2014. Are we able to claim unsafe living conditions because of the threats, and the drug use? The smell of his pot comes up through the vents, and we smell it every time the heat kicks on. Thoughts?

    Your landlord is not obligated to resolve every feud or dispute between neighbors. Apparently the police did not deem the threats of sufficient gravity to merit any form of prosecution.

    If you believe you and your family are actually in imminent danger as a result of the threats, you can consider seeking a protective order. Depending on whether you can convince a court to issue such an order, and the scope of the order obtained, it may affect whether the neighbor who made the threats can continue to reside in such close proximity to you.
