    Default Welfare Fraud Charges After Both Parents Claimed Children Lived in Their Households

    I live in New York state and my husband I are both being arrested on different charges for welfare fraud. It started when his ex wife applied for food stsmps in June 2013 one month after we got married and our cases became combined into one. He had always claimed his kids on his care for the last 5 yrs. Then once the case were combined she applied. She turned in custody papers..report cards...school records and 11 statements from ppl who stated we never had the kids at our house. Which in fact we did 5 nights a week. I turned in pictures and statements of our own and to no avail. The investigators said when they came out to our house the kids were never there. They came once that we know of and the kids were there. What do we do?

    defend yourself.

    given you were arrested and on welfare, I would presume you would qualify for a public defender. So, when arraigned, you plead not guilty and request a public defender.

    There is more...the investigator hasv called my ex husband who has nothing to do with this and given him information such as my physical address whichbi did not have to provide him becuz he has my po box and given him information about the case...more then I even know becuz she refusesvto return my calls and hasn't for 2 months. She also provided information about the case to my husband's ex wife

    the help you need needs to come from your lawyer. You are in a serious situation and should limit your disclosure of information to communications between you and only your lawyer.

    Plus, I don't think that there is enough information here (nor should you probably post enough information here) for us to really give you any viable help.

    It sounds like mom has good documentation for her position (custody papers, report cards, school records) but you don't have good documentation for yours.
